01.Overview

In most instances, when a company wants to hire a foreign worker to come to Canada, a Labour Market Impact Assessment (LMIA) is required. This assessment confirms that the foreign worker is indispensable and that reasonable efforts were made to hire a Canadian citizen or permanent resident first. LMIA's are received by the Employment and Social Development Canada (ESDC) which is responsible for social programs and the labour market at the federal level.

The International Mobility Program (IMP) provides several exemptions to this LMIA requirement, called R205(a) C10, this pathway is commonly known as the Significant Benefit category.

The IMP - Significant Benefit LMIA Exempt work permit is a variant where the foreign candidate needs to demonstrate a clear social or cultural benefit to Canada which is noticeable and clearly distinguishable. Candidates that have exceptional track record may receive a positive LMIA without advertising the position if the arrangement will result in a neutral or positive impact to the overall industry and labour market. In order to be successful, the government official will objectively assess the applicant's prior education and experience which prove that the applicant has been recognized as a leader in their field.

A business plan is considered to be a critical part of the application.
